Washington State Adopts Amendment Rule for the Children’s Safe Product Act

The Washington State Department of Ecology has amended the reporting rules for the Children’s Safe Product Act which requires companies to submit a report when a children’s product contains a chemical of high concern to children (CHCC). This amendment makes significant changes including an increase of the total number of chemicals of high concern to 85, added the exemption of inaccessible components from the reporting requirement and set the establishment of a single reporting deadline.


Key Highlights of the Reporting Rules Amendment


Reporting Deadline Changes

o Establishes a single reporting deadline for all children’s products and all companies.

      > Reporting due on January 31, 2019 must be based on CHCCs in children’s products offered for sale within the state of Washington between September 1, 2017 and December 31, 2018. 

      > The reporting due in 2020, and every year after, is due on January 31 and must be based on products sold within the state during the prior calendar year. 


CHCC Changes

o Adds the following 20 chemicals to the list of chemicals of high concern to children

Bisphenol S (BPS)Decabromodiphenyl ethane (DBDPE)
Bisphenol F (BPF)2-ethylhexyl-2,3,4,5tetrabromobenzoate (TBB)

      > Removes the Phthalic anhydride, Octamethylcyclotetrasiloxane and Molybdenum CHCC listings

      > Changes the listing for nonylphenol, which grouped three chemical compounds into one listing, into three individual CHCC listings


Other Significant Changes

o Explicitly exempts inaccessible components from any reporting requirements.

o Clarifies that the rule requires reporting of total concentration of each CHCC.

o Requires a copy of the previous year’s reporting to be resubmitted when there is no change in the information that is being reported for the current reporting year.
