US: “Truth in Fur Labeling Act” Signed into Law

On December 18, 2010 President Obama signed into law, the Truth in Fur Labeling Act of 2010. The Act eliminates the labeling exemption for products that contain relatively small quantities or values of fur. All fur products must now be labeled in accordance to the Fur Products Labeling Act (15 U.S.C. 69). The effective date of the amendment is 90 days after the date of the enactment of this Act, which is March 18, 2011.

Background
The new law amends Section 2(d) of the Fur Products Labeling Act (15 U.S.C. 69(d)) by removing the exemption for products with small quantities or values of fur in the definition of “fur product”. The definition in Section 2(d) will now read as:

The term "fur product" means any article of wearing apparel made in whole or in part of fur or used fur.


Also included in the Act is a requirement for the Federal Trade Commission (FTC) to review their Fur Products Name Guide (16 CFR 301.0). Within 90 days after the date of the enactment of the Act, the FTC will publish a notice in the Federal Register. The notice will include a review of the Fur Products Name Guide and provide an opportunity for industry to comment.
