Canada Publishes Revised Playpen Regulation

On October 3, 2018, the Canadian government published within the Canadian Gazette Part II revised requirements for Playpens. The revised regulation is designated as SOR/2018-186 and will become effective on April 3, 2019.  


Background Summary

The Playpen regulation was initially published under the Canadian Hazardous Products Act (HPA). The HPA was repealed and replaced by the Canada Consumer Product Safety Act (CCPSA) and the Playpen Regulation was listed in the CCPSA with the designation SOR/2016-189. In April of 2017, Health Canada published in the Canadian Gazette Part I the proposed revised regulations for Playpens and solicited comments from stakeholders. The regulation was revised to improve the safety when playpens are used and to strengthen the test evaluation conducted on playpens. The revision also aligns many of the Canadian Playpen requirements with the US requirements for Play Yards. 


Summary of Revised Regulation

The proposed Playpens Regulations includes the following;

• An addition for potential entrapment openings in the sides of playpens and accessories

• Requirements for mattress/floor pad spacing, thickness, and vertical displacement

• A proposal for incline sleep angles for accessories and segmented mattress pads

• Proposed warnings to appear on the playpen 

• An amendment to the current stability test

• Added requirements for top rails including latching and locking mechanisms, false latch, top rail configuration, and top rail to corner post attachment

• Added requirements for deflection and strength of sides

• Added a requirement for hazardous projections

• Added requirements for corner posts

• An increase of the height of the side from the mattress pad to the top rail

• An amendment to the openings (finger entrapment) requirement

• An amendment to the floor strength requirement

• A revised test method for the mesh openings 

• Added a requirement for mesh and fabric attachment strength

• Added requirements for accessories including entrapment hazards, side height, mattress pad thickness, integrity and sleep angle

• The removal of the previous wheel/caster requirement

• Assembly and use instructions can be contained in a pouch provided that the instructions contain specified and relevant warnings
