CPSC Office of the General Counsel Provides Draft Notice of Proposed Rulemaking for Baby Changing Products to the CPSC Commissioners

On August 17, 2016 the CPSC staff briefed the CPSC commissioners with a draft notice of proposed rulemaking for baby changing products. The proposed draft regulation will provide mandatory safety regulations for baby changing products under Section 104 of the Consumer Product Safety Improvement Act of 2008.

Background of CPSIA Requirements
Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. The Commission is proposing safety standards for baby changing products in response to the direction under Section 104(b) of the CPSIA.

A changing table is defined as an elevated, freestanding structure generally designed to support and retain a child with a body weight of up to 30 lbs. (13.6 kg) in a horizontal position for the purpose of allowing a caregiver to change the child’s diaper.

The CPSC staff recommends adopting the requirements specified in ASTM F2388-16, Standard Consumer Safety Specification for Changing Tables for Domestic Use, with modifications.

The modifications include;
• The addition of requirements for threaded fasteners and for secondary support straps that should improve the structural integrity of the baby changing product
• The addition of performance requirements for restraint straps if one is included on the baby changing product
• Revisions to the current warning requirements and the inclusion of a suffocation warning statement
• Proposal to require a marking for both the address and the telephone number of the manufacturer rather than one or the other

The draft NPR must be voted upon by the CPSC Commissioners. If approved, the NPR will be published within the federal register at which point interested parties may provide comments to the CPSC staff.
