On June 25, 2019, the European Commission published Regulation (EU) 2019/1021 Persistent Organic Pollutants (POPs) (recast) in the Official Journal of European Union (OJEU). The recast Regulation maintains all provisions of the existing POPs Regulation and includes certain amendments in order to improve the clarity and functioning of the Regulation. The recast will enter into force on July 15, 2019 and the Regulation (EC) No 850/2004 will be repealed.
Regulation (EC) No 850/2004, also known as the POPs Regulation, has been substantially amended several times. Since it is necessary to make further amendments, the Regulation should be recast in the interests of clarity.
The following are the major changes in the prohibition of the manufacturing, placing on the market and use of substances, whether on their own, in mixtures or in articles listed in Annex I.
• Flame retardant requirements are amended
• Decabromodiphenyl ether (DecaBDE) is newly included

• Certain CAS no. of Perfluorooctane sulfonic acid and its derivatives (PFOS) are included
o CAS no. 1763-23-1, 2795-39-3, 29457-72-5, 29081-56-9, 70225-14-8, 56773-42-3, 251099-16-8, 4151-50-2, 31506-32-8, 1691-99-2, 24448-09-7, 307-35-7
• Pentachlorophenol (PCP) and its salts and esters is newly included
o Articles containing PCP and its salts and esters is prohibited to be placed on the market
Effective Date: July 15, 2019
