A proposal has been drafted by the Bureau of Electronic and Appliance Repair, Home Furnishings and Thermal Insulation to remove the TB 133 reference from the Title 4 of the California Code of Regulations, Sections 1374 and 1374.3. 


The proposed amendment to Section 1374 Title 4 of the California Code of Regulations removes the reference to TB 133 and its requirements that "all upholstered seating furniture sold for use in publicly- occupied buildings shall meet the flammability test requirements set forth in TB 133”. 


In addition, if the proposal is adopted, Section 1374.3 will also be amended to remove the requirement to have labels on upholstered seating furniture for products meeting TB 133. The removal of this requirement aligns this section with Section 1374 and establishes TB 117-2013 as the standard for furniture in publicly-occupied buildings.  It also will reduce the need for chemical flame retardants and thereby, decrease the exposure to hazardous chemical flame retardants.
