New Directives in European Union for Electrical and Electronic Products

In the course of implementation of the New Legislative Framework in European Union, new directives have been published in 2014, in particular in electrical and electronic fields.

What has changed for economic operators?

Context:
In 2014, the European Commission published the recast of several CE marking directives. Among the new directives impacting electrical and electronic products, there are the following ones:
Low Voltage Directive (LVD) 2014/35/EU (previous 2006/95/EC)
• EMC Directive 2014/30/EU (previous 2004/108/EC)
• Radio Equipement Directive (RED) 2014/53/EU (previous R&TTE 1999/5/EC)
• ATEX Directive 2014/34/EU (previous 94/9/EC)


These new directives will be applicable in 2016.

The directives recast are undertaken to align with the following New Legislative Framework:
• Regulation (EC) No 765/2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products
• Decision No 768/2008/EC on a common framework for the marketing of products
• Regulation (EC) No 764/2008 laying down procedures relating to the application of certain national technical rules to products lawfully marketed in another Member State

Changes:
The alignment of directives with the New Legislative Framework concerns the following points: • Clear definition of economic operators
• Reminder the obligations of economic operators
• Reminder on traceability: ex. distance selling
• Definition of concepts such as “placing on the market”
• Clarification of conformity assessment procedures (Modules)
• Clarification of responsibilities of market surveillance authorities

No substantive change of technical requirements in new directives.
